The Corruption Perception Index (aka #CPI) from Transparency International is out today.#impunity means "exemption from punishment or freedom from theinjuriousconsequences of an action" according to Oxford.Political interference happens when public institutions, like the Court of Justice, and governments do not respect their boundaries. When this happens it reflects on the perception of corruption of a country.There are lots of other actions and inactions from the government that have an impact on the perception of corruption. Any other examples?

Transparency International’s newly released 2023 Corruption Perceptions Index draws on data from the WJP #RuleofLawIndex. The report focuses on the intersection of rule of law, corruption, and the justice system. One pillar of strong #RuleofLaw is absence of corruption. When the rule of law is strong, officials are held accountable for corrupt actions.

In a historic decision, a seven-judge panel of the Supreme Court overturned a 25-year-old precedent, declaring that bribery charges against members of parliament and legislative assemblies cannot be shielded by parliamentary privileges. This landmark judgment dismantles the 1998 "PV Narasimha Rao" ruling, which granted immunity under Articles 105(2) and 194(2) of the Constitution.The Court declared, "Corruption and bribery by legislators erodes the bedrock of our democracy. It undermines the aspirations and ideals enshrined in the Constitution, leading to a system that fails to deliver responsible, responsive, and representative governance to the citizens."This monumental decision, delivered by Chief Justice DY Chandrachud, clarifies that legislators no longer possess immunity from prosecution for bribery related to their votes or speeches within the legislature.The court also noted bribery is not rendered immune under Articles 105 or 194 because a member engaging in bribery indulges in a criminal act which is not essential for the function of casting a vote or giving a speech in the legislature.#BriberyCharges #ParliamentaryImmunity #Democracy #SupremeCourt[Supreme Court, Bribery, Legislators, Immunity, Corruption, Public Interest]

It was a great pleasure to take part in the roundtable discussion on enforcing court judgments, organized by the Supreme Court, the Association of Private Enforcement Officers, and the EU Project Pravo-Justice. Protecting creditors and investors goes beyond the frontiers of the rule of law; it's a core aspect of economic justice and and prevention corruption. Ensuring that creditors' claims are properly enforced is crucial for EU integration. It's encouraging to see that the judges of the Supreme Court are actively involved in promoting private enforcement and protecting creditors. In Latin America and the Caribbean, the lack of independence and transparency of the judiciary promotes corruption and the undue influence of political and economic elites. This renders many justice systems across the region incapable of applying the law effectively in an impartial manner or exercising their function as a check on other branches of government, which is fundamental for all well-functioning democracies. http://anticorru.pt/2Vx
